正在准备诉讼材料,我也正好做点功课,不清楚国际雪联的准则是否适用于法庭,但可以想到的是,这些虽然不是直接有法律依据的材料文字,但对审判最起码有一定的影响力。
独自学习总不如和大家一起讨论,所以将国际雪联的10条安全准则贴出来,以后遇到同样事的时候,无论撞人还是被撞,最起码可以有个依据。希望国内的滑雪环境越来越好的同时,不要走糙快猛的路子,缓发展,把软件做好,如此才是长久发展之计。

国际雪联十条滑雪安全准则(全文转抄,简单翻译,10 FIS rules for conduct,rule for safty 以下简称10 rules或十条准则,翻译得有问题或者水平烂,请批评指正,造福雪友)
10 FIS rules:
1. Respect for others
A skier or snowboarder must behave in such a way that he does not endanger or prejudice others.
无论双板还是单板滑雪者,都应该遵循以下行为准则:绝不做出将会损伤或致使他人受伤的行为。
2. Control of speed and skiing or snowboarding
A skier or snowboarder must move in control. He must adapt his speed and manner of skiing or snowboarding to his personal ability and to the prevailing conditions of terrain, snow and weather as well as to the density of traffic.
无论双板还是单板滑雪者,都应当让自己的滑行处于可控范围之内。其滑行速度和方式应当和其个人滑雪水平相符,并且应根据地势、雪质、天气和雪场人口密度来选择以何种方式滑行。
3. Choice of route
A skier or snowboarder coming from behind must choose his route in such a way that he does not endanger skiers or snowboarders ahead.
后方滑雪者务必要选择不危及前方滑雪者的线路滑行。(前方滑雪者有雪道使用的优先权)
4. Overtaking
A skier or snowboarder may overtake another skier or snowboarder above or below and to the right or to the left provided that he leaves enough space for the overtaken skier or snowboarder to make any voluntary or involuntary movement.
超车时,请保持足够距离。
5. Entering, starting and moving upwards
A skier or snowboarder entering a marked run, starting again after stopping or moving upwards on the slopes must look up and down the slopes that he can do so without endangering himself or others.
当滑雪中途稍作休息重新开始,或者向坡上攀爬时,务必保证不危及到自己及其他人的安全。
6. Stopping on the piste
Unless absolutely necessary, a skier or snowboarder must avoid stopping on the piste in narrow places or where visibility is restricted. After a fall in such a place, a skier or snowboarder must move clear of the piste as soon as possible.
除非必须,滑雪者应避免停留在赛道、狭窄的雪道、视线易受阻的地方,若经过上述地点,请尽快通过。
7. Climbing and descending on foot
A skier or snowboarder either climbing or descending on foot must keep to the side of the piste.
如需在雪道上行走时,请务必在雪道两侧。
8. Respect for signs and markings
A skier or snowboarder must respect all signs and markings.
请滑雪者务必对信号牌、指示牌和指示物保持足够的重视。
9. Assistance
At accidents, every skier or snowboarder is duty bound to assist.
一旦遇见事故,每个滑雪者都有义务去帮助受伤的人。
10. Identification
Every skier or snowboarder and witness, whether a responsible party or not, must exchange names and addresses following an accident.
事故后的滑雪者或者目击者,无论是否有相关责任,都应该彼此留下联系方式。

看起来这些东西更像是人道上的责任和义务……
这里感叹一下,当时现场有位大哥在离开雪场时碰见在大厅讨论事故责任的时候,路过大声指责撞人者。因为他当时差点被同一人撞到,闪开后就把朋友给撞了。大哥就是当时最直接的目击者,但只是谴责撞人者,在我和朋友再三挽留下因种种原因不肯作证并离开,我个人表示很遗憾,但是也可以理解大哥这么做的根本原因,只能说社会如此,需要提高的不仅是雪圈。
在这里发帖,也是希望滑雪的时候,这四方,撞人者、被撞者、目击者、滑雪场都能积极地去面对这个事情,滑雪不是弹棉花,伤痛不可避免,本来伤痛就是消极的东西,一旦纠缠在扯皮和逃避上,就更让人觉得毫无希望。在明媚的阳光下和雪白的雪道上跳跃的潇洒身体里,映出的应该是颗朴实纯洁富有鲜红血液的善良之心才是。
